HISTORY:- Public  Interest Litigation was firstly introduced in the United States in the mid 1960s. Since the nineteenth century, various movement in that country had contributed to a public interest law, which was part of the legal aid movement. The first legal aid office was established in New York in 1876. In the 1960s the PIL movement began to receive economical support from the office of economic opportunities. In England PIL made a mark during the years of Lord Denning in the 1970s. He was the petitioner brought several public issue in the court. History of PIL in India: PIL had begun in India toward the end of 1970s and came into full bloom in the 80s. An example to understand law of compensation. A man on bike while trying to avoid a pothole on road, struck with a truck and died on spot. The heirs can claim compensation/damages from two authorities. 1) Compensation from insurance company of truck or its Owner. 2) Under law of tort, in civil court, damages from Municipality for negligence in not keeping roads potholes free. While calculating damages, the Civil Court will deduct compensation if any paid by the insurance company or owner of the truck. Fine Point of Law: The words Compensation and Damages have different meanings. Their calculations are different.

According to data published by National crime record bureau, number of such case rose to 160% between the year 2016 to 2019 to 93. But conviction rate is very low i.e 3.3%. These data clearly indicates that sedition law are being used to keep silence the voice of citizen. Government and its institution are directly violating the article 19(1) of the constitution of India. And the intention of government directly reflected. In India, sedition law was introduced in colonial era by British. -LUMA KANTA BHANDARI A fter President Bidhya Devi Bhandari’s step to dissolve House of Representative on the recommendation of Khadga Prasad Sharma Oli led government on last week, Everyone’s eye is toward Supreme Court. About two and half month ago, same Supreme Court reversed the decision of the government to dissolve the house of representative saying that it is unconstitutional. In the Judgment given by constitutional bench lead by Chief Justice Cholendra Rana, Supreme Court held that Government having majority in Parliament cannot dissolve Parliament under article 76(7) and 85. But the current scenario is totally different from previous ones. When President dissolve the house of Representative first time, KP Oli was the prime minister under article 76(1) but after the judgment of Supreme Court to break the ruling party Nepal Communist Party to CPN UML and CPN Maoist Centre, his Government was converted from 76(1) to 76(2) automatically.
